Based on Article 13 of the Swiss Federal Constitution and the federal data protection provisions (Federal Act on Data Protection, FADP), every person has the right to privacy and to protection against misuse of their personal data. The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the applicable data protection legislation and this Privacy Policy.

In cooperation with our hosting providers, we endeavour to protect the databases as effectively as possible against unauthorised access, loss, misuse or falsification.

Please note that data transmitted over the internet (e.g. when communicating by email) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.

3 Processing of personal data

Personal data means any information relating to an identified or identifiable person. A data subject is a person whose personal data is processed. Processing includes any handling of personal data, irrespective of the means and procedures used, in particular storing, disclosing, obtaining, deleting, retaining, modifying, destroying and using personal data.

We process personal data in accordance with Swiss data protection law. Where and to the extent that the EU GDPR applies, we also process personal data on the following legal bases in conjunction with Article 6(1) GDPR:

• point (a): processing of personal data with the data subject’s consent;
• point (b): processing of personal data for the performance of a contract with the data subject and in order to take corresponding steps prior to entering into a contract;
• point (c): processing of personal data for compliance with a legal obligation to which we are subject under applicable EU law or the applicable law of a country in which the GDPR applies in whole or in part;
• point (d): processing of personal data in order to protect the vital interests of the data subject or another natural person;
• point (f): processing of personal data for the purposes of our legitimate interests or those of third parties, except where such interests are overridden by the fundamental freedoms, rights and interests of the data subject. Legitimate interests include, in particular, our commercial interest in providing our website, information security, the enforcement of our own legal claims and compliance with Swiss law.

We process personal data for as long as is necessary for the relevant purpose or purposes. Where we are subject to longer-term retention obligations based on statutory or other requirements, we restrict processing accordingly.

3.1 Server log files

The provider of this website automatically collects and stores information in server log files, which your browser automatically transmits to us. This information includes:

• browser type and browser version;
• operating system used;
• referrer URL;
• host name of the accessing computer;
• time of the server request.

This data cannot be attributed to specific individuals. It is not combined with other data sources. We reserve the right to review this data retrospectively if we become aware of specific indications of unlawful use.

3.2 Contact form

If you send us enquiries via the contact form, the information you provide in the enquiry form, including the contact details entered there, will be stored by us for the purpose of processing the enquiry and handling any follow-up questions. We do not disclose this data without your consent.

4 Disclosure of data

When providing our services, we use external service providers that collect or process your personal data on our behalf. These fall into the following categories:

• IT service providers for data hosting services;
• marketing service providers (e.g. media agencies, advertising networks, publishers, Google and social media platforms) in connection with marketing activities (e.g. competitions, marketing campaigns and analytics cookies);
• customer communication service providers;
• market research institutes;
• e-commerce providers (e.g. retail platforms, proprietary platforms and other third-party providers).

Where service providers process personal data as processors, they are obliged to process personal data exclusively in accordance with our instructions and to implement data security measures.

Data may also be disclosed to other recipients, such as courts and authorities in connection with proceedings and statutory duties to provide information and cooperate, purchasers of companies and assets, financing companies in the context of securitisations, and debt collection agencies.

In individual cases, we may also disclose personal data to other third parties for their own purposes, for example if you have given us your consent or if we are legally obliged or entitled to do so.

In addition, we disclose your personal data within IT Academy and/or to third parties only if:

• you have given your express consent;
• this is necessary for the performance of a contractual relationship with you;
• processing is necessary for compliance with a legal obligation;
• processing is necessary for the purposes of our legitimate interests or those of a third party, and there is no reason to assume that you have an overriding interest to the contrary.

5 Transfer of personal data to third countries

Our website includes tools provided by companies based in the USA, among others. When these tools are active, your personal data may be transferred to the US servers of the companies concerned. We draw your attention to the fact that the USA is not a secure third country within the meaning of EU data protection law. US companies are required to disclose personal data to security authorities without you, as the data subject, being able to take legal action against this. It therefore cannot be ruled out that US authorities (e.g. intelligence services) may process, evaluate and permanently store data located on US servers for surveillance purposes. We have no influence over these processing activities.

6 Use of cookies

This website uses cookies. These are small text files that make it possible to store specific information relating to the user on the user’s device while the user is using the website. Cookies make it possible, in particular, to determine how frequently pages are used and the number of users, to analyse patterns of website use and to make our offering more user-friendly. 7 External services

We use various third-party services on our website. Below, we explain in detail which services are involved, what we use them for and what data is collected.

7.1 Google services

This website may use Google Maps to embed maps, Google Invisible reCAPTCHA to protect against bots and spam, and YouTube to embed videos.

These services provided by the US company Google LLC use cookies, among other things, resulting in data being transferred to Google in the USA. We assume that, in this context, no personal tracking takes place solely as a result of using our website.

Google has undertaken to ensure an adequate level of data protection in accordance with the EU–US and Swiss–US Privacy Shield frameworks.

7.1.1 Google hCaptcha

When certain sub-services of our website are accessed, additional personal data is processed. The categories of data processed are technical connection data relating to server access (IP address, date, time, page requested and browser information), data about the use of the website, and records of clicks on individual elements. The purpose of processing is to prevent non-human and automated input. The legal basis for processing is a legitimate interest that overrides the rights and freedoms of data subjects (Article 6(1)(f) GDPR). The legitimate interests in this context are a strong economic interest in the secure and functional operation of the technical systems. Data is transferred to the processor Intuition Machines, Inc., 1065 SW 8th St #704, Miami, FL 33130, USA (https://www.hcaptcha.com). This may also involve the transfer of personal data to a country outside the European Union. Data is transferred to the USA on the basis of Article 45 GDPR in conjunction with the European Commission’s adequacy decision C(2023) 4745, as the data recipient has undertaken to comply with the data processing principles of the Data Privacy Framework (DPF).

7.1.2 Google Tag Manager

Google Tag Manager is a solution that enables us to manage website tags through an interface and thereby integrate services such as Google Analytics and other Google marketing services into our online offering. Tag Manager itself, which implements the tags, does not process users’ personal data. 7.1.3 Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Ireland Limited. If the controller responsible for data processing on this website is located outside the European Economic Area or Switzerland, Google Analytics data is processed by Google LLC. Google LLC and Google Ireland Limited are hereinafter referred to as “Google”.

The statistics obtained enable us to improve our offering and make it more interesting for you as a user. This website also uses Google Analytics for cross-device analysis of visitor flows, which is carried out using a user ID. If you have a Google user account, you can disable cross-device analysis of your use in the account settings under “My Data”, “Personal Data”.

The legal basis for the use of Google Analytics is Article 6(1), sentence 1, point (f) GDPR. The IP address transmitted by your browser as part of Google Analytics is not combined with other Google data. Please note that Google Analytics has been extended on this website by the code “_anonymizeIp();” to ensure that IP addresses are collected anonymously. This means that IP addresses are processed in truncated form so that they cannot be associated with a specific person. If the data collected about you can be attributed to a person, that association is immediately excluded and the personal data is deleted without delay.

Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google uses this information to evaluate your use of the website, compile reports about website activity and provide the website operator with other services relating to website and internet use. For the exceptional cases in which personal data is transferred to the USA, Google has submitted to the EU–US Privacy Shield: https://www.privacyshield.gov/EU-US-Framework.

Google Analytics uses cookies. The information generated by the cookie about your use of this website is generally transferred to a Google server in the USA and stored there. 7.2 Embedded fonts

7.2.1 Font Awesome

10 Data security

For security reasons and to protect the transmission of confidential content, such as enquiries you send to us as the website operator, this website uses SSL/TLS encryption.
